MINCE’s Cosmetics & Beauty Product Exhibition Day-3: NAFDAC Intervention

The third day of the exhibition started with exhibitors and visitors exposed to the nitty-gritty of the role of NAFDAC in promoting export of cusmetics and beauty product in Nigerian.

A paper delivery by the Ebele P. Anto, Deputy director, Cosmetics/Medical services Drug Evaluation and Research, titled NAFDAC Regulation of Made In Nigeria Cosmetics, highlighted key areas which included NAFDAC Laws, why regulate cosmetics and the role of the agency in regulation of cosmetics and beauty products.

Explaining the objectives of the intervention, the paper urged participants to ensure that to understand the basic requirements that regulate MSMEs in cosmetics productions and the roles of NAFDAC and the industry. Specifically participant were enjoined to understand that the National Agency for Food and Drug Administration and Control (NAFDAC) Act Cap N1 Laws of the Federation of Nigeria, empowers the Agency to regulate and control the manufacture, importation, exportation, distribution, advertisement, sale and use of food, drug, cosmetics, medical devices, packaged water and chemicals.

The paper presentation also dwells on the Food, Drugs and Related products (Registration, etc) Act Cap F33, an Act to regulate the manufacture, importation, exportation, advertisement, sale or distribution of regulated products and registration thereof, the Prohibition of the manufacture, etc., of unregistered processed food, drugs, etc. O (1) No processed food, drug, drug product, cosmetic, medical device or water shall be manufactured, imported, exported, advertised, sold or distributed in Nigeria unless it has been registered in accordance with the provisions of this Act or regulations made.

On the role of NAFDAC in regulations of consumable, the paper exposed participants to the following:
* To fulfil the mandate, NAFDAC deploys regulatory instruments Regulations and guidelines.
* The regulations are legal documents, and any breach of the provisions is punishable by law. E.g. Cosmetic Products Labelling Regulations, 2021, Cosmetic Products Advertisement Regulations, 2021

For example, Regulation two of the Cosmetic Products Advertisement Regulations, 2021 stipulates that “A person shall not advertise a cosmetic product unless the (a) product is registered by the Agency (b) advertisement is approved by the Agency.
